How can a summons be served in Florida?

 

Florida has 67 counties and each one of the counties has its own special rules and regulations when it comes to serving a summons.  Some counties have certified process servers; some have appointed servers; some have counties are served by the sheriff and still other counties are motion and order counties where you have to submit a motion to have a special server appointed.  Check with the servers listed in the particular county on our website and ask them about your particular need.  Also, check out our service of process site for more information

 

Do you have to have a proof of service affidavit notorized if it is served by a Certified Process Server in the State of Florida?

 

If a process server is certified by the Court or Sheriff in the State of Florida, the affidavit does not have to be notarized.

 

How can a Subpoena be served in Florida?

 

A subpoena in the State of Florida can be served by any person over the age of 18 who is not involved in the case.  However, remember, you may have to have this person testify in court as to serviceof the subpoena.  That is why we recommend bonded and certifed process servers to serve subpoenas.  This gives you peace of mind that the service is done properly and there will be no delays because of questionable service.

 

Do I have to have the sheriff serve a summons in the State Of Florida?

What hours can process servers work?

 

The only time set by Florida Statute that process servers can not serve is Sunday.  Other than that, they can serve 24 hours a day.  However, you may want to specify a start and cut off time for your server.  If a server makes an attempt a 2:00 in the morning, you may start problems that you really do not want.  Most professional servers will not start before 7:00 am and will not serve after 9:00 pm in order to avoid problems.

Foreclosue summons' can be served by process servers in Florida.  There are a few counties where the Sheriff must serve these, however the majority of the counties in Florida can be served by a certified process server.  Check with your server for the rules in the particular county.

 

Can a 3 day notice be served by a process server?

 

You can serve a 3 day notice or you can have a process server serve it for you.  If you think there might be a problem getting the occupants to vacate, you might consider having a disinterested third party, such as a professional process server, serve the three day notice.  That way there is no question as to the service and the date of service.

  

Can a process server help me find people I need served?

 

Many servers off a simple locate service that can assist you in finding new addresses for a defendant.  However, may want the server to perform a full Skip Trace on those hard to find defendants or defendants that are avoiding service.

 

What is meant by "Skip Trace"?

 

A skip trace is a detailed report on a perticular person you are trying to locate.  Some severs use public databases on the net and others use database sevices that gives you a very detailed report.
